Деякі правопорушення особа здійснює свідомо, умисно, розуміючи, що вона порушує встановлені правила. А от порушення Правил дорожнього руху водієм може бути й неумисним — якщо він не помітив дорожній знак, що обмежував швидкість, або випадково забув удома водійське посвідчення. Однак навіть коли особа скоїла правопорушення неумисно, з необережності, вона може бути притягнута до відповідальності за скоєне.</span></p>

Так, адміністративний арешт може тривати до 15-ти діб, арешт з утриманням на гауптвахті — до 10-ти діб, ці стягнення накладає тільки суд; тривалість виправних робіт як адміністративного стягнення не може перевищувати двох місяців. Для кожного правопорушення Кодексом України про адміністративні правопорушення визначено перелік стягнень, які можуть бути застосовані в цьому випадку. Але визначити стягнення, яке потрібно застосувати в конкретному випадку, повинен той орган, який розглядає справу. Відповідальність за адміністративні правопорушення настає із 16 років, але для притягнення до відповідальності неповнолітніх осіб установлено особливі вимоги. Він не передбачає ізоляції засудженого від суспільства, однак полягає в обмеженні згідно з вироком суду прав і свобод засудженого, із застосуванням наглядових та соціально-виховних заходів. При цьому засуджений повинен періодично з’являтися для реєстрації до уповноваженого органу з питань пробації, повідомляти уповноважений орган з питань пробації про зміну свого місця проживання, роботи або навчання, не виїжджати за межі України без погодження з уповноваженим органом з питань пробації. Додатково суд може покласти на засудженого до пробаційного нагляду обов’язки використовувати електронний засіб контролю і нагляду та проживати за вказаною у рішенні суду адресою, обмежити спілкування, пересування та проведення дозвілля, працевлаштуватися або тати на облік у службі зайнятості для пошуку роботи, пройти курс лікування від наркотичної, алкогольної залежності, розладів психіки та поведінки внаслідок вживання психоактивних речовин або захворювання, що становить небезпеку для здоров’я інших осіб. Пробаційний нагляд призначається на строк від одного до п’яти років.</span></span></p>
